Acceptable Use Policy

This Acceptable Use Policy ("AUP") is issued by Netrows Labs SL ("Netrows Labs", "we", "us", or "our") and describes the specific conduct that is and is not permitted when using Kooperativa's API, dashboard, and Data (together, the "Services"). It exists as its own document, separate from the Terms of Service, so we can clarify or extend it as new misuse patterns come up without reopening the entire contract. It does not replace the Terms of Service; the two are read together, and a breach of this AUP is a breach of the Terms.

1. Purpose and relationship to the Terms

This AUP is incorporated into, and forms part of, the Terms of Service by reference. Where the Terms of Service already describe a restriction (for example the B2B-only scope, or the prohibition on redistributing Data), this AUP restates it briefly and adds detail; where the two appear to conflict, the more specific and more recently updated document governs for the particular conduct in question.

2. Business use only

You may not use the Services to:

  • build, power, or operate any product, feature, or workflow accessible to consumers, including a consumer-facing lookup, people-search, background-check, or vetting tool;
  • offer the Services, or access to Data obtained through them, to an individual who is not acting on behalf of a business; or
  • use the Services for a personal, family, or household purpose of any kind.

For clarity, this section is about who can use the Services, not what the Data itself contains: the Data is professional profile and firmographic information only. Kooperativa does not offer email addresses, phone numbers, or any other personal contact detail, so there is no contact data to misuse in the first place.

3. Prohibited regulated uses

You may not use the Data:

  • as a factor in determining an individual's eligibility for credit, insurance, employment, housing, or a government benefit or license, or for any other purpose that would make it a "consumer report" under the U.S. Fair Credit Reporting Act or an equivalent law in any jurisdiction;
  • to infer or derive special categories of personal data (health, religion, political opinion, trade union membership, genetic or biometric data, or sexual orientation) about an individual;
  • to make an automated decision about an individual that produces a legal or similarly significant effect on them; or
  • in a way that discriminates against an individual on the basis of race, color, religion, national origin, sex, age, disability, genetic information, sexual orientation, gender identity, or any other characteristic protected under applicable anti-discrimination law.

4. Security and platform integrity

You may not:

  • attempt to gain unauthorized access to any account, API key, system, or network belonging to Netrows Labs or another Customer;
  • probe, scan, or test the vulnerability of the Services, except where explicitly authorized by us in writing (for example, a disclosed security research engagement);
  • circumvent or attempt to circumvent rate limits, authentication, or any other access control, including through multiple accounts, proxying, request queuing, or distributed systems designed for that purpose; or
  • introduce malware, or use the Services to relay or facilitate an attack against a third-party system.

5. Copying and redistribution

You may not copy, extract, or systematically redistribute the Data, in raw, enriched, or derived form, to a third party, or use it to build a database or dataset made available to a third party, whether for a fee or free of charge, without our prior written consent. Liquidated damages for a breach of this section are set out in the Terms of Service.

This does not prevent ordinary internal use: storing enriched records in your own CRM or data warehouse for your own business's use, or sharing a specific record with a colleague inside your organization as part of normal work, is not redistribution.

6. Conduct toward individuals

You may not use the Data to:

  • contact, monitor, or research a specific individual for a personal reason unrelated to their professional or business role, including dating, personal curiosity, or reconnecting with someone socially;
  • harass, stalk, intimidate, or threaten any individual; or
  • send unsolicited bulk email or engage in spam.

Reasonable professional outreach (for example, a sales or recruiting message sent to a work contact about a legitimate business opportunity) is the intended use of the Services and is not itself a violation of this section.

7. Sanctioned use

You may not use the Services if you, or the business you act on behalf of, are located in a country or territory subject to comprehensive trade sanctions, or are listed on a restricted or denied party list, as described in the Terms of Service.

8. Enforcement

A violation of this AUP is a material breach of the Terms of Service. Depending on the severity and pattern of the conduct, we may warn the Customer, throttle or suspend access, terminate the account without refund, invoice for excess infrastructure cost caused by the violation, or pursue any other remedy available under the Terms of Service or applicable law, including the liquidated damages described there for unauthorized redistribution.

9. Reporting a violation

If you believe a Kooperativa Customer is violating this AUP, contact us at support@kooperativa.io. We review every report and will follow up with you where a response is appropriate. If you are an individual with a concern about your own professional data specifically, use the data removal request form instead, described in the Privacy Policy.

10. Changes to this policy

We may update this AUP from time to time, in particular to address a new misuse pattern as it emerges, without necessarily reopening the full Terms of Service. Material changes will be notified the same way changes to the Terms of Service are: by email or through a notice on the Site or dashboard.
